The Team You Will Be Joining
The state agency serves Texans by ensuring every citizen’s final disposition is conducted professionally and ethically. The agency protects the public from deceptive practices in the funeral and death care industry through a process of impartial enforcement, inspection, licensing, and education, acting through two primary services: Licensing and Compliance. Their work helps ensure Texans’ dignity, integrity, and agency throughout their lives.
 
Major Duties
  • Represent the agency in administrative hearings before the State Office of Administrative Hearings (SOAH), independently or in collaboration with the Office of the Attorney General
  • Review complaints and investigative reports involving licensed and unlicensed activity; determine jurisdiction and next steps
  • Partner closely with the Enforcement Division to develop cases, assess evidence, and support investigations
  • Negotiate and resolve cases through informal settlements and alternative dispute resolution
  • Draft and prepare legal documents including Notices of Hearing, Agreed Orders, motions, briefs, and final orders
  • Advise Commissioners, the Executive Director, and staff on legal matters, regulatory interpretation, and case strategy
  • Provide guidance on federal and state laws to internal stakeholders and the public
  • Review proposed rules for legal sufficiency and compliance with the Administrative Procedure Act and Texas statutes
  • Monitor legislative and regulatory changes impacting the agency and ensure ongoing compliance
  • Collaborate with local, state, and federal enforcement partners on investigations and prosecutions
  • Draft Attorney General Opinion requests and responses, and support legislative inquiries and bill analysis
  • Prepare legal correspondence on behalf of agency leadership
  • Monitor compliance with Agreed Orders and enforcement outcomes
  • Perform related duties as assigned
 
What are we looking for?
  • Juris Doctor (J.D.) from an accredited law school
  • Licensed to practice law in the State of Texas and in good standing with the State Bar
  • Two years of experience as a full-time licensed attorney in administrative, civil and/or criminal law and procedures
  • Experience in public speaking
  • Knowledge of Texas laws, rules of evidence, and discovery and investigative procedures
     
Preferred Qualifications
  • Experience working in a licensing or regulatory agency
  • Skill in working with investigative/enforcement staff
  • Knowledge of Administrative Procedure Act, Public Information Act, and Open Meetings Act
 
Exciting Opportunity Details
  • Hourly Rate: $48.00/hour
  • Length of Engagement: Through August 31st, 2026; potential for extension/full-time placement
  • Days/Hours: Monday – Friday (Standard Business Hours; 40 hours/week)
  • Location: Austin, TX 78701
  • Work Arrangement: Fully onsite (5 days/week)
